Virginia Punishments for DUI

In Virginia, Driving While Intoxicated, under the influence of alcohol, drugs or a combination of both, is a Class 1 misdemeanor, which carries a maximum punishment of one year in jail and a $2,500 fine.  (View the relevant Virginia Code section that defines DWI here, and the section that describes the punishments for Class 1 misdemeanors here.)

Anyone convicted of DUI is required by Virginia law to lose his or her license for one year or longer for repeat offenses.  Anyone convicted is also required to participate in the Virginia Alcohol Safety Action Program (VASAP) — a drunk driving education program that costs $300.  The punishments for DUI escalate with repeat offenses.  For example, someone convicted of a fourth DUI within ten years of a prior conviction is subject to a mandatory one-year jail sentence.  (View the relevant Virginia Code section that describes DUI specific punishments here.)

Problems With the Intoximeters Intox EC/IR II

Roanoke County, Roanoke City, the City of Salem, Montgomery County, and Botetourt County use the Intoximeters Intox EC/IR II breath alcohol machine to interpolate blood alcohol levels.  Mr. Bosen and his legal team have travelled to the Department of Forensic Science (DFS) Headquarters in Richmond, Virginia, as well as the DFS Western Lab, to review, analyze, and scan or copy thousands of DFS records relating to the accuracy, precision, and reliability of the Intox EC/IR II.  Mr. Bosen maintains working relationships with scientists from major universities who testify in court about real limitations and potential problems with the Intox EC/IR II and its testing methodologies.
