Virginia Punishments for DUI
In Virginia, Driving While Intoxicated, under the influence of alcohol, drugs or a combination of both, is a Class 1 misdemeanor, which carries a maximum punishment of one year in jail and a $2,500 fine. (View the relevant Virginia Code section that defines DWI here, and the section that describes the punishments for Class 1 misdemeanors here.)
Anyone convicted of DUI is required by Virginia law to lose his or her license for one year or longer for repeat offenses. Anyone convicted is also required to participate in the Virginia Alcohol Safety Action Program (VASAP) — a drunk driving education program that costs $300. The punishments for DUI escalate with repeat offenses. For example, someone convicted of a fourth DUI within ten years of a prior conviction is subject to a mandatory one-year jail sentence. (View the relevant Virginia Code section that describes DUI specific punishments here.)
Effective DUI Defense Strategies
Mr. Bosen has practiced law for over forty years in Roanoke, Salem, Christiansburg, and Fincastle courts. During this time, he has developed multi-layered and multi-pronged strategies for defending DUI cases. Mr. Bosen’s strategies include:
-
- lifestyle considerations,
- biochemical calculations,
- review of medical conditions,
- evaluation of arresting officer performance,
- access to evidence, and
- reliability of any breath testing machine used to estimate blood alcohol level (BAC).
In the vast majority of cases, at least one of these strategies works, and can combine with others for an even more effective defense.
Mr. Bosen first investigates the pertinent details of the case, then considers which of his defense strategies to employ. He seeks to have charges dismissed, if warranted. Then he attempts to pre-negotiate a set reduction in charges before trial, working directly with the prosecutor and law enforcement officers involved. If a trial is the best option, Mr. Bosen fights in court.
Problems With the Intoximeters Intox EC/IR II
Roanoke County, Roanoke City, the City of Salem, Montgomery County, and Botetourt County use the Intoximeters Intox EC/IR II breath alcohol machine to interpolate blood alcohol levels. Mr. Bosen and his legal team have travelled to the Department of Forensic Science (DFS) Headquarters in Richmond, Virginia, as well as the DFS Western Lab, to review, analyze, and scan or copy thousands of DFS records relating to the accuracy, precision, and reliability of the Intox EC/IR II. Mr. Bosen maintains working relationships with scientists from major universities who testify in court about real limitations and potential problems with the Intox EC/IR II and its testing methodologies.
