08/07/24Montgomery County Circuit Ct.Grand Larceny; Tamper With a Vehicle; Enter a Vehicle With Intent to Damage it; Destruction of PropertyThe Grand Larceny charge was amended to Unauthorized Use of A Motor Vehicle and that was taken under advisement for two years with client to do 100 hours of community service and be of good behavior; the Tamerping charge resulted in conviction and a 6 mo. jail sentence with all but 2 days suspended; the other two charges were dismissed. At the end of the Commonwealth;'s case at trial, Mr. Bosen moved to strike the Commonwealth's evidence and dismiss the case and that motion was granted and the Indictment was dismissed.N/A

07/22/24Roanoke County General District Ct.Misdemeanor Hit and RunReduced to Improper Driving, a minor traffic offense. NB: the prosecution wanted the Clinet convicted of the original charge and wanted 90 days in Jail and 12 months probation. Mr. Bosen did not allow the Client to accept that deal and instead tried the case with the Judge and was able to get this favorable outcome.$50.00 Fine; $71.00 Court Costs
07/17/24Montgomery County general District Ct.DUI 1stMr. Bosen through his efforts was able to get the DUI charge amended to Reckless Driving and have the Judge take the case under advisement for 6 months. If client completes VASAP and has no other convictions and completes 25 hrs. of community service, the charges will again be amended to Improper Driving, a minor traffic offense carrying the least amount of points. He will then have only a$100 fine. If he does not comply, he will be convicted of RD and get a $500.00 fine..$124.00 Court Costs
07/1724Roanoke City General District Ct.DUI 1st; RefusalClient was convicted of DUI 1st, Refusal was dismissed. Luckit he refused the breath test because the PBT at the scene of the stop was .216. 07/10/24Ronaoke County General District Ct.DUI 1st (Enhanced .26 BAC); Consuming Alcohol While Operation a Motor VehicleMr. Bosen was able to have the charge amended to strike the enhanced language and he was able to keep the BAC test result out of evidence. Client was convicted on the evidence such a the field tests and was sentenced to 6 mos. in jail with all suspended except for 5 days (he will actually only have to serve 2.5 days); his licenses was suspended for 12 months and he was granted a restricted OL with the only restriction being ignition interlock; he was ordered to attend VASAP which he has already begun pre-trial at Mr. Bosen's suggestion. 06/25/24Salem General District Ct.Petition for Restoration of Firearm RightsPetition granted - client had received a TDO two years ago but did not realize it since he had been released from a mental health clinic where he sought treatment for a temporary issue., A Dr. reviewed his case shortly after the TDO and released him after deter=mining he was OK. The client did not check the box about TDOs on a firearm purchase application and got charged with a Felony! That felony will be dismissed since Mr. Bosen was able to get his firearm rights restored.N/A

06/12/24Botetourt County General District Ct.Reckless Driving (102/55)This case was aggravated because the Officer testified that the client was passing on a two lane road and actually part of the passing was on a double yellow line and client was approaching the officer. The client followed Mr. Bosen'sm advice and completed 47 hrs. of volunteer service and a driver improvement course pre-trial. which helped mitigate thew punishment. The client was convicted, sentenced to ten days in jail (he will pull only 5 days); his license was suspended for 60 days, but he was granted a restricted OL.$750.00 Fine; $115.00 Court Costs
06/10/24Montgomery County General District CourtDUI 1stClient had health issues due to a pregnancy where Mr. Bosen and her physicians felt it was unsafe to travel. Mr. Bosen was able to get the Commonwealth's Attorney (prosecutor) to agree to waive jail time. The case was tried without the client being present. Client was convicted primarily because of the BAC form the breath test and over Mr. Bosen's Motions to dismiss. Her privilege to drive in VA was suspended for 12 months, she was given a restirctied license with the only restriction being ignition interlock; she was ordered to complete an ASAP program in Washington State where she now resides.$500 Fine; $219.00 Court Costs

05/28/24Alleghany County General District CourtReckless Driving 100/70; Fail to Display License PlatesDespite the fact that the client had a previous Reckless by speed in excess of 20 mph over followed a couple of month later by a speeding conviction of 10-19 over and was ordered thereafter to take a Driver Improvement course by DMV, Mr. Bose was able to keep his punishment at a really6 low level. Clinet was found guilty of Reckless Driving due to the prior DMV history of those convictions but was only given one night in jail to serve. Also, his license was suspended for 90 days, but he was granted a restricted license during that time period. The File to Display was dismissed.$100.00 Fine; $126.00 Court Costs

05/03/24SALEM CIRCUIT COURTDUI 1st w/BAC .19This case was appealed from the General District Court. It was imperative that the client did not get convicted of a DUI because he has a Commercial Driver's License in Michigan and runs his own lumber company and would not be insurable if he got convicted, in addition to a one year suspension of his CDL. We were able to get the charge amended to Reckless Driving. Client received a 60 day jail sentence (He had already done 24 days on a bond revocation and had 1 day credit from the arrest.), so he can do the final 10 days by pulling 5 days on weekends. The client had already completed VASAP before trial. He received no suspension of his CDL!$1,000 fine with $750 suspended. Costs to be determined.

Bosen was able to keep the damage at a minimum in that on the Reckless Driving he received 90 days in jail with all but six suspended and will be allowed to serve that sentence in one weekend. On the Hit & Run, 30 days in jail with all suspended. He also received a 30 days license suspension, but Mr. Bosen was able to convince the judge to allow him to have restricted driving privileges during that time.Reckless Driving fine is $750.00 with $500.00 suspended. (Client plead no contest to the amended DUI because her field test combined with the driving that caused the accident she was involved in and her admissions regarding drinking made post-arrest would have been sufficient for a Judge to find her guilty even without the BAC test.)$1000.00 fine with all but $200.00 suspended.

Mr. Bosen was retained for the first time on this case by client’s mother after he had served 10 years of a 30 year sentence (20 suspended) for a felony conviction more than 10 yrs. ago on a case on which Mr. Bosen had not represented him. Client violated probation soon after his release from prison by using illegal drugs and some other more minor violations. He was locked up in March of 2020 on the probation violations. Mr. Bosen was able to get him released immediately, provided he enter into a drug treatment program Mr. Bosen found for him where he lived, and provided he complete that program’s recommended treatment and that he remain drug free. The twenty years were again imposed but were suspended after credit for the time served since he was locked up.
